ONLY BLUEGREEN VACATION® CLUB OWNERS MAY PARTICIPATE IN THIS SWEEPSTAKES.  NO PURCHASE OR PAYMENTS ARE NECESSARY TO WIN.

1. HOW TO ENTER. Encore Rewards, Inc. (“ERI”) is the sponsor of this promotion.  Participants will receive one entry (chance to win) in the Sweepstakes for each Qualified Referral* guest who completes a Bluegreen Vacation Club sales presentation lasting approximately 90-120 minutes between June 1, 2008 and February 28, 2009. 

* A Qualified Referral must be an individual “personally known” to participant for whom participant provides correct and current name, address and home phone number, and who: (i) must be 25 years of age or older, (ii) is a resident of an Approved State (AL, AR, FL, GA, IL, IN, IA, KS, KY, MD, MI, MN, NC, NV, OH, OK, PA, SC, TN, TX, VA, WI), (iii) has an annual household income of at least $40,000, (iv) attends a Bluegreen Vacation Club® sales presentation (except where prohibited by law), (v) if married, both husband and wife must attend the presentation together, except where this requirement is prohibited by law, (vi) possesses a valid driver's license or other legal form of photographic identification and major credit card or major debit card and (vii) has not attended a Bluegreen presentation in the past 15 months.  To be "personally known" to a participant: 1.) a Qualified Referral  must have knowledge that the participant submitted his/her name to Bluegreen Resorts prior to submission; and 2.) the participant must not require compensation from the Qualified Referral for submitting the Qualified Referral's name to Bluegreen Resorts.  In all instances, Bluegreen shall have the exclusive right to determine if a referral is "personally known" to a participant and/or if a referral constitutes a Qualified Referral.

Bluegreen Vacation Club owners can submit referral guest names by completing an Encore Rewards referral sign-up form(s) available at all participating Bluegreen resorts and sales offices and returning the completed form(s) to any of these locations, or by mailing them to Bluegreen Corporation, 4960 Conference Way North, Suite 100, Boca Raton, FL 33431.  Owners can also submit referral guest names online at www.encorerewards.com or by calling the Encore Rewards Service Center toll-free at 866.362.6733.

2. Eligibility: Except where prohibited or restricted by law and/or where state registration and/or licensing requirements have not been met, the Sweepstakes is open to legal residents of the fifty (50) United States and the District of Columbia, age twenty-one (21) or older.  Employees, officers, directors, agents and their immediate family and non related household members of Sponsor, Sponsor’s parent company, affiliates and agents are not eligible.  This Sweepstakes is subject to all applicable United States federal, state and local laws and regulations.

3. PRIZES.  There will be one (1) grand prize awarded and a total of twenty-five (25) second prizes. 

The Grand Prize winner will have its annual Bluegreen Vacation Club maintenance fees paid by ERI for TEN years.  Retail value of Grand Prize is between $5,000.00—$10,000.00 with a maximum of $1,000.00 per year. Estimated odds of winning are 1:18000.  If prize recipient owns more than one Bluegreen timeshare interval, he/she will receive free maintenance fees for only one deeded property.

Second prize winners will have their annual Bluegreen Vacation Club Maintenance fees paid for 2010. Retail value of second place prize is $500.00 - $1,000.00 with a maximum of $1,000.00.  If prize recipient owns more than one Bluegreen timeshare interval, he/she will receive free maintenance fees for only one deeded property as selected by ERI in its sole discretion.   Estimated odds of winning are 1:720.

Odds of winning any prize depends upon the total number of Qualified Referral guests completing a Bluegreen Vacation Club sales presentation between June 1, 2008 and February 28, 2009.  There is no substitution of prize and it is non-transferrable.  Void where prohibited by law.

4. SELECTION OF WINNERS.  The winners will be selected in a random drawing from all eligible entries received by ERI during the promotion period (June 1, 2008 and February 28, 2009).  ERI will conduct the drawing at its corporate office (4960 Conference Way North, Suite 100, Boca Raton, FL 33431) on or about March 7, 2009.  Winners need not be present to win.  ERI will notify the winners by certified mail to be deposited with the US postal service by or about March 14, 2009.  ERI shall make all decisions concerning the sweepstakes and the drawing and such decisions will be final.  The winner(s) acknowledge and agree that acceptance of this prize constitutes permission for ERI and Bluegreen to use winners’ names, likenesses, cities and states of residence, the fact that he/she won a specific prize in the promotion, statements made by the winners and photograph rights for advertising and promotional purposes without additional compensation unless prohibited by law.  The identification of the official winners will be posted on www.encorerewards.com.  Winner will be required to complete an Affidavit of Eligibility/Liability and Publicity Release and a W-9 form.

Neither Sponsor, Sponsors’ parent company, Bluegreen Corporation,  nor any of their respective subsidiaries, affiliates, employees, officers, directors, shareholders, and/or agents (collectively “Related Parties”) shall be responsible for (and none will be  liable for): (i) late, lost, damaged, misdirected, incomplete, unintelligible entries; (ii) telephone, electronic, hardware or software program, network, Internet or computer malfunctions or transmission failures of any kind; (iii) any condition caused by events beyond the control of Sponsors that may cause Sweepstakes to be disrupted or corrupted; or (iv) any printing or typographical errors in any Sweepstakes materials. (v) any innocent error or conduct in connection with this promotion.  Sponsor shall have the right but not the obligation to disqualify any entries that sponsor believes, in its good faith but sole discretion, are fraudulent or otherwise improper or tainted. Indemnification: By participating you agree to release, indemnify, defend & hold the Related Parties, harmless from any & all losses, damages, injuries, rights, claims & actions, of any kind (including attorneys’ fees), in whole or in part, directly or indirectly, in connection with the Sweepstakes, or acceptance, possession, use or misuse of any prizes, including without limitation, personal injury, death & property damage, & claims based on publicity rights, defamation or invasion of privacy. Entrant hereby waives all rights to bring a class action suit or to claim, punitive, incidental or consequential damages, or any other damages, including attorneys’ fees, & entrant further waives all rights to have damages multiplied or increased.

The purpose of this contest is to obtain names/addresses of prospective customers who may be used for the purpose of soliciting the sale of a vacation timesharing plan or discount vacations.  Qualified Referral guests are under no obligation to purchase anything.  Timeshare interests may be offered by BVU at prices approximately between $7,200-$21,250 and sampler packages at a cost of approximately $895.00 each; No purchase of a timeshare interest is necessary. Inventory offered may vary.
